Campaña Latinoamericana y IIPE-UNESCO lanzan estudio sobre "Las Leyes Generales de Educación en América Latina - El derecho como proyecto político".

La investigación analiza en qué medida las leyes generales de educación vigentes en la región promueven la realización del derecho humano a la educación y la consolidación de los Estados como garantes de ese derecho.

The Expert Consultation on the Operational Definition of Basic Education, organised from 17 - 18 December 2007 at UNESCO, brought together eminent experts from different regions and further discussed a preliminary draft of operational definition that was initially proposed during the Experts’ Workshop on “Challenges and Perspectives of Law and Education” organised in Sao Paulo in December 2006.

This Consultation was part of UNESCO’s efforts to address the request by the Joint Expert Group UNESCO (CR)/ECOSOC (CESCR) on the Monitoring of the Right to Education and by experts during the “International Conference on the Right to Basic Education as a Fundamental Human Right and the Legal Framework for its Financing” (Jakarta, 2005), to initiate a reflection and dialogue process for the elaboration of an operational definition of basic education and to elaborate a definition that would be universally accepted and recognized.

In preparation for this meeting, UNESCO undertook a thorough analysis of recent policy and legal texts which illustrated the lack of linguistic consistency in the terms used to describe the initial stages of formal education (basic, elementary, primary, fundamental, secondary, basic learning needs, etc.). A Thematic Framework, prepared by the Secretariat of UNESCO presented the policy and international normative framework as well as the right to basic education in constitutions and national legislation. 

This guide, issued by the Office of the High Commissioner for Human Rights (OHCHR), focuses on how civil society can follow up on recommendations of United Nations (UN) human rights mechanisms and mandates or bodies.

As an integral part of UNESCO’s Constitutional mission for ensuring “full and equal opportunities for education for all”, the realisation of the Right to Education is one of the biggest developmental challenges, as millions of children and adults remain deprived of basic education in today’s learning societies.

This document is a short leaflet on the right to education.

According to UNESCO, 264 million children and youth are still out of school around the world, and this is only accounting for the primary (61 million) and secondary school (203 million) age population. In particular, the poorest and most marginalised, including ethnic and religious minorities, persons with disabilities, girls, and populations experiencing conflict, are often systematically unable to access and complete a full cycle of quality education. The first volume of NORRAG Special Issue (NSI) is dedicated to examining international frameworks and national policy as well as the challenges of fulfilling the right to education in practice.

The inaugural issue of NSI on the Right to Education Movements and Policies: Promises and Realities aims to highlight the global and national level experience and perspective on guaranteeing the right to education, as outlined in international frameworks, national constitutions, legislation, and policy, when creating the required administrative structures to ensure that the right is respected, protected, and fulfilled for all.

The Issue is divided into six parts, each focusing on a specific theme of right to education policy and practice. The first part includes an article written by RTE staff on The Role of Court Decisions in the Realisation of the Right to Education, which draws on RTE's background paper on accountability for the GEM Report 2017-8.

In this report, the Special Rapporteur looks with concern at the rapid increase in the number of private education providers and the resulting commercialization of education, and examines the negative effects of this on the norms and principles underlying the legal framework of the right to education as established by international human rights treaties. He highlights the repercussions of privatization on the principles of social justice and equity and analyses education laws as well as evolving jurisprudence related to privatization in education.

Finally, he offers a set of recommendations on developing effective regulatory frameworks for controlling private providers of education and safeguarding education as a public good.

Dans ce rapport, le Rapporteur spécial note avec préoccupation la multiplication rapide du nombre d’établissements d’enseignement privés et la commercialisation de l’éducation qui en découle. Il examine les effets néfastes de cette tendance sur les normes et principes qui constituent le fondement du cadre juridique du droit à l’éducation tel qu’il est consacré par les instruments internationaux relatifs aux droits de l’homme. Il met en évidence les répercussions de la privatisation sur les principes de justice sociale et d’équité et analyse la législatio n relative à l’éducation ainsi que l’évolution de la jurisprudence se rapportant à la privatisation de l’éducation.

Enfin, le Rapporteur spécial formule une série de recommandations concernant l’élaboration de cadres réglementaires efficaces permettant de soumettre les établissements d’enseignement privés à un contrôle et de faire en sorte que l’éducation demeure un bien public.

Dans le présent rapport, la Rapporteuse spéciale examine les différentes façons dont le droit à l’éducation contribue à prévenir les atrocités criminelles ainsi que les violations graves ou massives des droits de l’homme. La Rapporteuse spéciale soutient que l’éducation peut jouer un rôle essentiel à tous les stades de la prévention et souligne le pouvoir préventif particulièrement fort du droit à l’éducation tout au début du processus, avant même que les signaux de danger puissent être détectés. Ce rôle doit être associé aux objectifs de l’éducation et au droit à une éducation équitable, inclusive et de qualité, tel qu’ils sont consacrés par les instruments internationaux.

La Rapporteuse spéciale, après avoir décrit les circonstances dans lesquelles les écoles peuvent diviser au lieu de rassembler et préparer ainsi la voie aux conflits violents futurs, présente un nombre de mesures touchant l’organisation des systèmes scolaires, la pédagogie ainsi que les valeurs et les compétences à transmettre aux élèves, qui sont essentielles pour favoriser la prévention. Elle propose un cadre d’éducation (mieux connu en anglais sous le nom de « cadre ABCDE »), qui rassemble l’ensemble des caractéristiques nécessaires pour réaliser pleinement tout le potentiel préventif du droit à l’éducation.

En el presente informe, la Relatora Especial examina la forma en que el derecho a la educación contribuye a la prevención de crímenes atroces y violaciones masivas o graves de los derechos humanos. Destacando que la educación desempeña un papel fundamental en todas las etapas de la prevención, la Relatora Especial subraya el potencial preventivo particularmente contundente del derecho a la educación en las etapas tempranas, antes de que se hagan evidentes las señales de alerta. Ese papel debe vincularse con los propósitos de la educación y el derecho a una educación inclusiva y equitativa de calidad establecidos en los instrumentos internacionales.

La Relatora Especial, destacando las circunstancias en que las escuelas pueden convertirse en instrumentos de división y sentar las bases para el estallido de futuros conflictos violentos, presta especial atención a una serie de medidas relativas a la organización de los sistemas escolares, la pedagogía y los valores y conocimientos que se deben transmitir a los alumnos y que son cruciales desde el punto de vista de la prevención. Propone un marco educativo (conocido en inglés como “marco ABCDE”) que abarca los aspectos interrelacionados de la educación que es necesario promover para aprovechar al máximo el potencial preventivo del derecho a la educación.
