This background paper prepared for the Global Education Monitoring Report on non-States' actors in education: Who chooses? Who looses? provides both the rationale and the framework for re-centring a human rights’ perspective in education sector analysis. It draws on international human rights law as specified in the recently adopted Abidjan Principles on the human rights obligations of States to provide public education and to regulate private involvement in education, a landmark text for the interpretation of the right to education, in particular in the context of growing privatisation in and of education. The paper outlines how to use the Abidjan Principles to develop a tool to measure if and how States are implementing and individuals are enjoying those rights, with a specific focus on the role of non-State actors. We find that reframing education analysis through a human rights lens provides a sharp contrast to the narrow view of education as a human capital generator. Using the human rights framework of structures, processes, and outcomes, we not only detail questions which can guide future research and advocacy, but also demonstrate its use in evaluating data availability and sector plans in the United States and Côte D’Ivoire and re-evaluating existing conclusions from “The Role and Impact of Private Schools in Developing Countries” (Day Ashley et al., 2014). 

International and regional human rights bodies monitor and review progress made on the implementation of human rights treaties on a regular basis and continuously issue recommendations to States to improve the situation of children’s rights in each country. Civil society plays a crucial role in monitoring progress and challenges for children’s rights on the ground. Civil society practitioners often know about these processes and contribute to these recommendations. But not always are these recommendations systematically follow-up on to see what happens once the States receive them, and whether these recommendations are actually used to improve the situation. At the same time, many of us within civil society do not know about these processes and recommendations and miss opportunities that could strengthen our ongoing work.

This guide aims to empower and inspire civil society practitioners to follow-up, use and make the most of these recommendations as part of their daily work to advance realisation of children’s rights in their countries. To that end, it provides a step-by-step plan of activities to consider, with case studies and practical tips and formats to help us in that journey. It also provides some additional links with background information for those of us with less experience in this field.

UNESCO  and  partners  held  a  side  meeting during  the  Transforming  Education  Pre-Summit,  at  UNESCO  Headquarters entitled ‘Transforming  education:  the  need  to  expand  the  international  legal  framework’.  The  report presents the main issues raised and  suggested  areas requiring  further  protection  in  the  international  legal framework on the right to education. 

The Special Rapporteur on the right to education, Ms. Farida Shaheed, visited UNESCO from 16 to 20 January 2023. This report reflects the discussions held on present and future challenges for the right to education with many people across the Organization as well as other stakeholders during the visit and subsequently. It contains a summary of the Special Rapporteur’s main findings and recommendations, in particular to enhance the cooperation between UNESCO and her mandate.
