Human Right to education: horizons and meanings in the post-pandemic

The Latin American Campaign for the Right to Education (CLADE, by its Spanish acronym) is a pluralistic network of civil society organizations with a presence in 18 countries in Latin America and the Caribbean, which promotes social mobilization and political advocacy to defend the human right to education. This collection of articles, essays and statements reflect on the vital role of public education in the region and the fault lines exposed by the pandemic, considering both the challenges public education in Latin America faces and possible solutions, alternatives and ways forward.

In 2018, 17.2 million people were internally displaced as a result of natural disasters (IDMC 2019). Just one year later, in 2019, 24.9 million people were displaced due to natural disasters and extreme weather events (IDMC 2020). The catastrophic effects of climate change are no longer isolated emergencies, but have become the new global norm- a reality that is only intensifying each year. Yet the literature regarding climate change has little to no information on the specific nexus between climate displaced and their right to education.

China's “Bilingual Education” Policy in Tibet Tibetan-Medium Schooling Under Threat

China’s education policy in the Tibet Autonomous Region (TAR) is significantly reducing the access of ethnic Tibetans to education in their mother tongue. The government policy, though called “bilingual education,” is in practice leading to the gradual replacement of Tibetan by Chinese as the medium of instruction in primary schools throughout the region, except for classes studying Tibetan as a language.

Without education they lose their future: denial of education to child asylum seekers on the Greek islands

The 51-page report, “‘Without Education They Lose Their Future’: Denial of Education to Child Asylum Seekers on the Greek Islands,” found that fewer than 15 percent of more than 3,000 school-age asylum-seeking children on the islands were enrolled in public school at the end of the 2017-2018 school year, and that in government-run camps on the islands, only about 100 children, all preschoolers, had access to formal education.

European Parliament Resolution 2017/2206(INI)

On 3 July 2018, the European Parliament adopted a resolution on the violation of rights of Indigenous Peoples around the world. The Resolution 2017/2206(INI) stresses the importance of the Sustainable Development Goals (SDGs) with regards to Indigenous Peoples, including SDG 4.5 on access to education, and reiterates that Indigenous Peoples around the world suffer disproportionately from violations of human rights and insufficient access to education, among other fundamental rights.

According to UNESCO, 264 million children and youth are still out of school around the world, and this is only accounting for the primary (61 million) and secondary school (203 million) age population. In particular, the poorest and most marginalised, including ethnic and religious minorities, persons with disabilities, girls, and populations experiencing conflict, are often systematically unable to access and complete a full cycle of quality education.

Case-law summary: Center for Civil and Human Rights v ŠM Primary and Nursery School

The Prešov Regional Court, one of the courts of appeals of the Slovak Republic, affirmed a lower court’s decision that schools cannot discriminate against children based on their ethnic origin or socially disadvantaged background. The Prešov Regional Court held that the defendant school was discriminating against children of Romani ethnic origin by placing those kids in separate Romani classes. It ordered that the school rectify the situation by the beginning of the next school year.
