Decision on higher education tuition fees in public universities (Constitutional Court, France, 2019)

In 2019, the French Constitutional Court (Conseil Constitutionnel) was seized by student unions and associations regarding public higher education tuition fees concerning international students from outside of the European Union. The plaintiffs argued that under paragraph 13 of the preamble of the French constitution, public higher education should be equally accessible to all and free.

Les Droits de l’Homme exigent que les États assurent un accès égal à l'enseignement supérieur pour tous sans discrimination, et qu’ils garantissent la réalisation progressive du droit à l’enseignement supérieur gratuit. Malgré le fait que la France dépasse de nombreux pays de l'Organisation de Coopération et de Développement Économique (OCDE) quant à certains indicateurs relatifs à l'enseignement supérieur, des problèmes importants y subsistent. Surtout concernant  la garantie d’accès égal à tous et toutes à l'enseignement supérieur indifféremment de leur lieu d'origine.

Recommandation du conseil de l'Europe relative à des systèmes de qualité pour l’éducation et l’accueil de la petite enfance

Les objectifs de la recommandation sont: de développer un cadre et une compréhension commune dans toute l'Union Européenne de ce que constitue une prestation de services de bonne qualité en matière d'EPPE ; et de soutenir les États membres de l'UE dans leurs efforts pour améliorer l'accès à une EPPE de qualité.

Council of Europe Recommendation on High-Quality Early Childhood Education and Care Systems

The objectives of the recommendation are to: develop a common understanding across the EU of what constitutes good quality service provision with regard to ECCE; and support EU Member States in their efforts to improve access to and the quality of their ECCE systems. It outlines a set of recommendations to EU Member States and the EU Quality Framework for Early Childhood Education and Care, comprising ten quality statements structured along five broader areas of quality: access, staff, curriculum, monitoring and evaluation, and governance and finance.

Policy brief: The impact of place of origin on inequalities in higher education in France

International human rights law requires States to provide equal access to higher education without discrimination and to ensure the progressive realization of the right to free higher education. Although France outperforms many countries at the Organization for Economic Cooperation and Development (OECD) on many metrics regarding higher education, there remains significant problems, particularly ensuring equal access for students based on their place of origin. The opportunities students have, are not equal across all regions of France.

This report shows how a student’s place of origin within France, that is, the region in which they live prior to the beginning of their studies, coupled with their socio-economic background can mean that the cost of education, which is heavily influenced by the structure of the French higher education system, poses a significant barrier to their enjoyment of the right to higher education.
