Were Afraid for Their Future - Barriers to Education for Syrian Refugee Children in Jordan

“Today, Syrian refugee children in Jordan face a bleak educational present, and an uncertain future. Close to one in three—226,000 out of 660,000—Syrians registered with the United Nations refugee agency in Jordan are school-aged children between 5-17 years old. Of these, more than one-third (over 80,000) did not receive a formal education last year.”

In this report, the Special Rapporteur argues that treating economic and social rights as human rights is essential both for efforts to eliminate extreme poverty and to ensure a balanced and credible approach in the field of human rights as a whole. He argues that economic and social rights currently remain marginal in most contexts, thus undermining the principle of the indivisibility of the two sets of rights.

Separate and Unequal: School Funding in ‘Post-Racial’ America

In 1973, the U.S. Supreme Court held that a public school funding system based primarily on local property tax revenues does not violate the Fourteenth Amendment’s Equal Protection Clause nor does it violate the right to education because, although education is an ‘important service’ it is not a fundamental right, as recognised by the U.S. Constitution.

Convention relative aux droits de l'enfant

La Convention relative aux droits de l'enfant (CIDE) s'applique aux enfants de moins de 18 ans. Elle reconnaît l'éducation comme un droit à chaque enfant sur la base de l'égalité des chances. Son article 28 garantit la gratuité de l'enseignement primaire obligatoire pour tous, la gratuité progressive de l'enseignement secondaire qui devrait en tout état de cause être disponible et accessible à tous, et l'accessibilité à l'enseignement supérieur en fonction des capacités. Il énonce l'obligation de l'État de prendre des mesures concernant la fréquentation scolaire.
