En los países latinoamericanos, la necesidad de disponer de recursos adicionales para financiar los servicios sociales, la infraestructura y la inversión educativa ponen de manifiesto la urgencia de vincular fiscalidad y educación en las discusiones sobre las políticas públicas. Para incrementar la inversión social en educación es necesario que la comunidad educativa regional considere activamente la relevancia que la actual estructura tributaria y en específico el impacto que los flujos financieros ilícitos (FFI) tienen sobre el desfinanciamiento de la inversión social, ya que significan pérdidas cuantiosas en términos de ingresos tributarios no recaudados. 

À la lumière des normes relatives aux droits de l'Homme concernant le droit à l'éducation et de l'objectif de développement durable (ODD) 4, les organisations de la société civile signataires cidessous expriment de sérieuses inquiétudes quant aux implications potentielles de l’étude récemment publiée "Can Education be Standardized ? Evidence from Kenya" (L'Éducation peutelle être standardisée ? Données du Kenya). Nous exhortons les gouvernements et les autres parties prenantes à reconnaître les limites de cette étude, que certains chercheront à utiliser pour justifier l'expansion de l'offre éducative privée à but lucratif et des méthodes d'enseignement scénarisées1 . Il existe des approches bien établies pour relever les défis auxquels sont confrontés certains systèmes éducatifs et nous exhortons toutes les parties prenantes à se concentrer sur les stratégies et les politiques éducatives qui ont fait leurs preuves en matière d'éducation inclusive, équitable et de bonne qualité, et qui contribuent à renforcer l'éducation publique pour toutes et tous.

In the light of human rights standards on the right to education and the Sustainable Development Goal (SDG) 4, the signatory civil society organisations below raise serious concerns about the potential implications of the recently released working paper “Can Education be Standardized? Evidence from Kenya". We urge governments and other actors to recognise the limitations of this study, which some will seek to use to justify the expansion of for-profit private provision of education and scripted teaching methods. There are well established approaches to address the challenges faced by some education systems and we urge all actors to focus on education strategies and policies that have been proven to deliver inclusive, equitable and good quality education, and that contribute to strengthening public education for all.

This documented was submitted to the UN Special Rapporteur on the right to education in February 2023, in response to a call for contributions for a report she is developing for the UN Human Rights Council.

In the present report, submitted pursuant to Human Rights Council resolutions 8/4 and 44/3, the Special Rapporteur on the right to education addresses the risks and opportunities of the digitalization of education and their impact on the right to education.

The Special Rapporteur calls for discussions relating to the introduction of digital technologies in education to be framed around the right of every person to free, quality, public education and the commitments of States in this regard under both international human rights law and Sustainable Development Goal 4.

In particular, the implementation of the right to education must respond to the needs of all persons to access, master and use technology as an empowering tool for being active members of society. The digitalization of education should be geared towards a better implementation of the right to education for all, where it is demonstrated that it brings a significant added value. In this regard, it is important to understand the profit-driven agenda of digital technology lobbyists and companies. In addition, the digitalization of education should not increase inequalities and benefit already privileged segments of societies only or lead to violations of other human rights within education, in particular the right to privacy.

Ce rapport porte sur le droit à l’enseignement supérieur et interroge le respect par la France de ses obligations concernant l'article 2.2 et l'article 13.2 (c) du Pacte international relatif aux droits économiques, sociaux et culturels (PIDESC).

Il est basé sur un projet de recherche de cinq ans développé par l'Initiative pour le droit à l'éducation (RTE) en collaboration avec des étudiant·e·s de la Clinique de droit de Sciences Po (Paris) et des chercheur·e·s de l'Université de Genève, de l'Université d'Orléans et de l'ENS Paris Saclay

Notre rapport souligne que les politiques publiques, visant à réduire les inégalités dans l'accès à l'enseignement supérieur, mises en œuvre par le gouvernement français depuis la dernière revue périodique, sont insuffisantes et doivent être renforcées et étendues. Il soutient que les inégalités structurelles, territoriales et socio-économiques ainsi que la politique de financement de l'enseignement supérieur de l'État entravent l'égalité et la non-discrimination dans l'accès à l'enseignement supérieur et renforcent la tendance à la privatisation.

This joint statement signed by RTE and 18 CSOs responds to a report published in September 2023 by the International Development Committee (IDC) of the UK House of Commons, entitled ‘Investment for development - The UK’s Strategy towards Development Finance Initiatives. The report’ raises major concerns about the UK’s investments as part of development aid which the signatory organisations working on education share and reiterate. In this joint statement we respond to this report and express our concern about the British International Investment’s (BII) activities and impacts in key sectors responsible for delivering human rights, including education and health.

This report, jointly produced by Right to Education Initiative; La FAGE, Fédération des Associations Générales Etudiantes; and Global Students Forum, focuses on the right to higher education, questioning France’s compliance with its obligations regarding article 2.2 and article 13.2 (c) of the International Covenant on Economic Social and Cultural Rights (ICESCR).

It is based on a five year research project developed by the Right to Education Initiative (RTE) in collaboration with students from Sciences Po Law School Clinic (Paris) and researchers from the University of Geneva, University of Orléans and ENS Paris Saclay

This submission highlights that the public policies aiming to reduce inequalities in access to higher education implemented by the French government since the last periodical reporting session are insufficient, and need to be reinforced and expanded. It argues that structural, territorial, and socio-economic inequalities as well as the State’s higher education financing policy hinder equality and non-discrimination in access to higher education and increase the privatisation trend.

Dans son rapport, la Rapporteuse spéciale passe en revue les résultats obtenus dans le domaine du droit à l’éducation et expose la manière dont on conçoit ce droit et les obligations qui en découlent, ainsi que les questions contemporaines et nouvelles dont il convient de tenir compte pour garantir le droit à l’éducation pour tous, aujourd’hui et à l’avenir.
