Since the treaty was entered to force, it has been signed by 131 countries and ratified by 37. Jamaica was the first country to ratify the Convention, and on 3 April, Ecuador ratified, providing the sufficient number of parties for the Convention to enter into force.

The Optional Protocol to the Convention on the Rights of Persons with Disabilities is a side-agreement to the Convention which allows its parties to recognize the competence of the Committee on the Rights of Persons with Disabilities to consider complaints from individuals. The text is based heavily on the Optional Protocol to the Convention on the Elimination of All Forms of Discrimination against Women.

The Optional Protocol entered into force with the Convention on 3 May 2008. As of July 2008, it has 71 signatories and 22 parties.
