National Constitutional provisions – Burkina Faso
The constitution is the fundamental law of the country, reflecting the underlying and unifying values of society. It spells out the basic rights of each person; it serves as a framework for all other laws and policies, and cannot be easily changed. However, it can be changed and updated through a democratic process, and it is important to keep it alive, by popularising and using it, and by campaigning for its reform or amendment if necessary. Below we have picked out what we see as some of the most relevant articles, but please be encouraged to seek and read your constitution in its entirety.
The state is the central actor in any claim to the right to education: it is the prime duty-bearer and the prime implementer; it is the guarantor; and it is the state´s signature vis-à-vis the international norms and standards which binds it to respect, protect and fulfil the right to education. The state must therefore be judged or challenged on its central text on the right to education, whether this be the constitution, the laws or the policies.

EDUCATION
Art.18
Education, instruction, formation, (…) constitute the social and cultural rights recognized by the present Constitution which aims to promote them.
Art.27
Every citizen has the right to instruction.
Public education is secular.
Private education is recognized. The law establishes the conditions of its exercise.
Tous ont une égale vocation à jouir de tous les droits et de toutes les libertés garantis par la présente Constitution.
Les discriminations de toutes sortes, notamment celles fondées sur la race, l'ethnie, la région, la couleur, le sexe, la langue, la religion, la caste, les opinions politiques, la fortune et la naissance, sont prohibées.
L'éducation, l'instruction, la formation, le travail, la sécurité sociale, le logement, le sport, les loisirs, la santé, la protection de la Maternité et de l'Enfance, l'assistance aux personnes âgées ou handicapées et aux cas sociaux, la création artistique et scientifique, constituent des droits sociaux et culturels reconnus par la présente Constitution qui vise à les promouvoir.
Le mariage est fondé sur le libre consentement de l'homme et de la femme. Toute discrimination fondée sur la race, la couleur, la religion, l'ethnie, la caste, l'origine sociale, la fortune est interdite en matière de mariage.
Les enfants sont égaux en droits et en devoirs dans leurs relations familiales. Les parents ont le droit naturel et le devoir d'élever et d'éduquer leurs enfants. Ceux-ci leur doivent respect et assistance.
